About the Role

Part of the Compliance team led by the Chief Compliance Officer, this role is accountable for providing legal advice on and managing competition law and compliance risk, with a particular focus on supporting our teams across Minerals Australia (MinAus). The role will also provide competition law advice and support more generally across our other global teams when required.  In addition, the role will provide input into the Competition Law Compliance Framework, including the development of supporting materials, monitoring and other second line accountabilities.

Key accountabilities include but are not limited to: 

  • Lead competition law advice and compliance for MinAus teams, including managing engagements with senior leadership.
  • Engage with external counsels and counterparties to manage competition law risk.
  • Provide expert advice on all aspects of competition law compliance throughout the MinAus business and supporting teams, and other business regions where required from time to time. 
  • Provide updates and advice, including to senior management, on relevant developments in competition law enforcement and policy and the potential impact for BHP, including in respect of current priorities such as climate change and the growth strategy. Incorporate relevant developments into the Competition Law Compliance Framework and associated materials.
  • Develop relationships with relevant competition law organisations, in particular the ACCC, as required to remain up-to-date on current enforcement practices. 
  • Provision and procurement of anti-corruption and trade controls compliance-related legal advice and guidance, including in relation to the management of risk, contractual protections and embedding compliance-related legal policies and procedures. 
  • Conduct (or oversee external counsel to conduct) internal investigations in response to potential competition law or compliance-related breaches.

  • Excellent analytical and problem-solving capability and strategic thinking. Ability to understand complex issues and identify and execute creative solutions.
  • Ability to adopt a commercial, business focused approach in considering issues and implications of competition law enforcement policy.
  • Very strong communication skills, including written communications skills, with an ability to inspire confidence and to explain (both orally and in writing) complex issues.
  • Ability to work in a matrixed organisation, including navigating cross-functional relationships to build internal networks to successfully deliver outcomes.
  • Project management skills and an ability to work cross-functionally to identify issues, solutions and importantly, outcomes.
  • Ability to work with ambiguity and complexity and adapt and flex in line with changing business priorities.

It is expected that candidates possess the following experience and technical competencies: 

  • Functional expertise in competition law, including relevant domestic and, ideally, also  international legal frameworks.  
  • Competition lawyer subject matter expert, with at least 8 years post qualification experience, with broad experience across all aspects of competition law and ideally (but not required) with some multi-jurisdictional experience.
  • Deep understanding of the competition law enforcement landscape, including key soft law frameworks and emerging trends, in Australia
